Called To Order The meeting was called to order by Council President Stan Snapp with the Pledge of Allegiance led by Marty Mulholland.

ANNOUNCEMENT(S)

    · On Monday, January 24, at 10:15 a.m. in the Mayor’s Board Room there will be a City Council Lake Whatcom Reservoir and Natural Resources Committee Meeting regarding Lake Whatcom Initiatives.
    · On Monday, January 24, 7:00 p.m. at City Council Chambers in there will be a Public Hearing regarding 2011 Comprehensive Plan Amendment docketing.

Bellingham City Council meets all requirements of the State of Washington Open Meetings Act.


TRANSPORTATION BENEFIT DISTRICT NO. 1
    · On Monday, January 10, 1:00 p.m. in Council Chambers there will be a meeting of the Transportation Benefit District No. 1 Board to discuss transit service, transportation projects and budget.

APPROVAL OF MINUTES

KNUTSON / BUCHANAN moved approval of the December 6, 2010, December 13, 2010 and January 3, 2011 minutes of the regular Council Meetings as submitted. MOTION CARRIED 6-0, BORNEMANN late arrival.


15 - MINUTE PUBLIC COMMENT PERIOD

Council Member Bornemann arrived at the meeting

Yoshé Revelle referenced the recent shooting of an Arizona Congresswoman and several others. He shared his thoughts with regard to political parties and how, though there may be differing opinions, they should not divide people. Once people are divided they can lose connections with others and tragedy’s such as this one can happen.

Johnny Grames shared his thoughts on Sunday bus service, the need for a public forum with regard to traffic cameras and concerns about the executive sessions.

Leonard Lindstrom discussed social issues.


PRESENTATION(S)

AB19071 1. MAYOR’S STATE OF THE CITY ADDRESS

Mayor Pike presented his 2010 State of the City Address to the council and citizens of Bellingham. Mayor Pike reviewed the events of 2010 and many citizens and staff who have contributed so greatly to the City of Bellingham.

Mayor Pike said, “the interdepartmental efforts of the staff pay off big time, saving us dollars and enhancing our customers’ experiences.”

He assessed the year ahead and said there would be particular emphasis on: Economic Development, Lake Whatcom, Government Efficiency and Advances in Stewardship & Sustainability. He concluded that revenues are looking slightly better but [the city] must avoid the temptation to stretch beyond its' means.

Mayor Pike introduced a resolution during committee.

“A RESOLUTION REQUESTING THE GOVERNOR OF THE STATE OF WASHINGTON TO DIRECT THE STATE DEPARTMENT OF ECOLOGY TO ISSUE AN EMERGENCY RULE CLOSING THE LAKE WHATCOM RESERVOIR WATERSHED TO NEW GROUNDWATER WITHDRAWALS.”

FLEETWOOD / KNUTSON moved final approval of Resolution #2011-01. MOTION CARRIED 7-0.

AB19073 1. BOULEVARD OVER WATER WALKWAY

Information was provided to Council during committee on the City's request for a De minimis (4f) exemption.

          2. OLD/NEW BUSINESS

Council Member Bornemann announced that the 20th Martin Luther King celebration will be held January 17, 2011 at the Bellingham Municipal Court at noon.

Council Member Lilliquist announced that direction was given to staff to prepare an ordinance for council consideration that would more clearly reflect language in Bellingham Municipal Code 20.20.060 Comprehensive Plan and Neighborhood Plan Amendment Decision Criteria “D”.

    WEISS / BORNEMANN moved to approve the hiring of outside counsel to represent the City regarding potential water rights claims. MOTION CARRIED 7-0.

      FINAL CONSIDERATION OF ORDINANCES

      AB18995 1. AN ORDINANCE AMENDING BELLINGHAM MUNICIPAL CODE SUBSECTION 15.42.050 D AND ADDING BELLINGHAM MUNICIPAL CODE SUBSECTION 15.42.050 E TO ADD REQUIREMENTS THAT RETAIL ESTABLISHMENTS SELLING FERTILIZERS, MULCHES, AND SOIL AMENDMENTS CONTAINING PHOSPHORUS PROVIDE SIGNAGE AND LITERATURE NOTIFYING CUSTOMERS OF PROHIBITED USES OF PHOSPHOROUS FERTILIZERS, MULCHES, AND SOIL AMENDMENTS IN THE LAKE WHATCOM WATERSHED, EXTENDING THE PROHIBITION FROM LAWNS AND TURF TO INCLUDE ALL GARDENING AND HORTICULTURAL APPLICATIONS, EXTENDING PHOSPHORUS FERTILIZER PROHIBITIONS TO COMMERCIAL PROPERTIES IN THE WATERSHED, AND REPEALING THE EXEMPTION FOR LAWNS IN THE FIRST GROWING SEASON.
