Chapter 28 PUBLIC WORKS ADVISORY BOARD

2.28.040 - POWERS AND DUTIES

A. The Board may review and advise the Mayor and Council regarding Public Works development standards and policies relating to public and private construction.

B. In order to provide third-party input into the development of Capital Improvement Plans, the Board may review and advise the Department, Mayor and Council on such plans of the City for street, water, sewer and stormwater management. The Board may be requested by the Mayor or Council to review capital construction projects.

C. The Board may review and advise the Mayor and Council concerning the Public Works Department consultant qualification and selection process.

D. The Board may review and advise the Mayor and Council concerning the Public Works Department permitting and inspection processes.

E. The Board may, upon the request of the Mayor, City Council, or an applicant to the Public Works Department provide assistance and recommendation to the City Council or the Department on technical matters relating to Public Works decisions and recommendations to the City Council which involve City of Bellingham development standards or construction practices.

If such a request is made the technical matters in question shall be described by the requestor on a standard form provided by the Public Works Department. The form shall be submitted to the Department which shall transmit it, together with such additional information as the Department deems appropriate, to the Board not later than 3 days prior to the public meeting at which the matter will be considered by the Board. Unless another time is mutually agreed to by the affected participants, the Board should hold a public meeting to consider the request and pertinent information presented at the meeting within 14 days of the Department's receipt of the request, provided that, exception in the case of an emergency, the notice of the meeting shall be sent to the members, participants and anyone else who has requested notice, at least 7 days prior to the meeting. The public meeting conducted by the Board shall not be an open record hearing as defined in RCW 36.70B.

The Board may make a recommendation to the City Council or Department regarding some or all of the issues involved. If the Board makes a recommendation, it shall be submitted to the Department or Council, as appropriate, within 14 days of the date the request is received by the Board. The Council or Department may adopt, modify or reject such recommendation. If the matter is one which requires a City Council decision, the recommendation of the Board shall be transmitted to the Council along with the recommendation of the Department.
