AB19442 1. Presentation by Caitac USA Corporation regarding rezones and development agreements

Darcy Jones, Project Engineer

Mr. Marriner gave a brief history of the City’s interest in the project. Mr. Carmichael and Mr. Jones provided a PowerPoint presentation of the background, chronology, and plan for development of 114 lots on 551 acres on the Guide Meridian.

At 1:08 PM Council President, Terry Bornemann, adjourned the meeting to Executive Session to hear the following items:

Litigation: Futurewise, et al. v. Whatcom County [Growth Board Appeal of County's Rural Element Update] - (Marriner)

At 1:30 PM Council President Terry Bornemann called the meeting back to order.

EXECUTIVE SESSION REPORT

Alan Marriner reported that Council was asked for direction as to whether the City should appeal Whatcom County Ordinance 2011-043, which made additional changes to the County’s Rural Element. The City appealed the main ordinance changing the County’s Rural Element, Ordinance 2011-013, adopted by the County in May 2011. The hearing on the merits before the Growth Management Hearings Board [GMHB] on the appeal of Ordinance 2011-013 was held on November 21, 2011, and today the City received the GMHB’s 177 page decision in the case. The Ordinance under consideration now made changes to the Rural Residential Density Overlay adopted by the County in May by Ordinance 2011-013 and considered by the GMHB in the decision the City just received. The deadline for filing an appeal on Ordinance 2011-043 is tomorrow before there is an opportunity to fully review and understand the impact of the GMHB’s decision on the Rural Residential Density Overlay in the appeal of Ordinance 2011-013.

GK/SS MOVED TO APPROVE DIRECTION TO STAFF TO FILE AN APPEAL. The motion carried 6-0-1. CL abstained.
