The City of Bellingham Hearing Examiner will hold a public hearing to take testimony on the following proposals:

1. SUB2008-00010 / VAR2008-00009: Consideration of lot width variances from BMC 18.36.020 E. as part of a proposed One and Three-quarter Rule for the R. T. Hammond Short Plat #2289. The proposal would create a 4,600 square foot lot and a 5,175 square foot lot, and reduce the interior lot width requirement from 50 feet to 40 feet and reduce the corner lot width requirement of 60 feet to 45feet. The property is located at 1100 21st Street, and legally described as Fairhaven’s Land Company’s First Addition to Fairhaven Lots 1, 2, and 3, Block 87 - TOG WI S 10' Knox Ave ABTG Lot 1. Margo Hammond, owner/applicant. Residential Single Land Use Designation. Happy Valley Neighborhood, Area 5.

2. VAR2012-00011: Request for a variance from the setback requirement from Northshore Drive in order to develop a 25' x 21' patio. The setback requirement from Northshore Drive is 60' from the center line of the right-of-way (30' from the northern property line). The request is for a zero-foot setback from the property line abutting Northshore Drive in order to comply with the 25' setback required from the ordinary high water mark (OHWM) of Lake Whatcom. Application of both setbacks does not allow reasonable use of the subject property. The patio is setback approximately 30' from the OHWM of Lake Whatcom. The patio footprint also includes a 10' x 12' roof and 7' x 17' storage shed. The proposal will not impact the existing Native Vegetation Protection Area along the eastern property line. The property is located at 1201 Northshore Drive (lengthy legal). Tom and Kerri Lenderman, owners/applicants. Urban I Shoreline Designation and Residential Single, Detached Land Use Designation. Silver Beach Neighborhood, Area 3.

The full applications are available for viewing at the address listed below. Staff reports will be available at the Planning Department approximately one week before the hearing.

You may comment on the proposal by sending written comments to the Planning Department, City Hall, 210 Lottie Street, Bellingham, WA 98225. All written comments should be received during office hours before the hearing, or you may submit them at the hearing if you include an additional copy for the recording secretary. You may also request a copy of the Hearing Examiner’s decision and your appeal rights.
