The City of Bellingham Hearing Examiner will hold a public hearing to take testimony on the following proposals:

1. CUP2013-00001: A Conditional Use Permit for the installation of a pet crematory into an existing industrial building. The Northwest Clean Air Agency (NWCAA) will require an air pollution permit for this new crematory. This permit will limit emissions based on the best available control technology for each air pollutant -- taking into account energy, environmental and economic impacts, and other costs. The project is located at 801 W. Orchard Drive #3, and legally described as Lot 5 Squalicum Corporate Park Shortplat. Industrial, Light Land Use Designation. Bobbie Ruth Langley, owner/applicant. Cornwall Park, Neighborhood, Area 3.

2. VAR2013-00011 / VAR2013-00018 / CAP2013-00014: A Variance request of 10 feet from the front yard setback requirement, to develop a single-family residence to be located at 1108 Inverness Lane, and legally described as Lot B of the Shady Short Plat. The proposed front yard setback reduction will move the proposed residence further away from the habitat conservation area and geologically hazardous areas and associated buffers. The proposal also includes a Critical Areas Variance request to reduce the habitat conservation area buffer from 150 feet to 50 feet from the ordinary high water mark (OHWM) of Cemetery Creek, and reduce the building setback line from the buffer from 15 feet to 0 feet. The full applications are available for viewing at the address listed below. Staff reports will be available at the Planning Department approximately one week before the hearing.

You may comment on the proposal by sending written comments to the Planning Department, City Hall, 210 Lottie Street, Bellingham, WA 98225. All written comments should be received during office hours before the hearing, or you may submit them at the hearing if you include an additional copy for the recording secretary. You may also request a copy of the Hearing Examiner’s decision and your appeal rights.
