    NOTICE OF DECISION
    and
    CONDITIONAL USE PERMIT


    REQUEST: A Conditional Use Permit proposal to increase the Bayside Swimming Club membership from 173 to 200. The property is located at 502 Clark Drive, and
    legally described as Lot 1 Block 2 Halley Plat. Single-Family Residential Neighborhood Land Use Designation. Edgemoor Neighborhood, Area 5.

    HEARING EXAMINER DECISION DATE: March 25, 2009

    DECISION: Approved with conditions. See the full Hearing Examiner Order at address listed below or at www.cob.org/cob/helog.nsf.

    Membership may be increased to a total of 190 members during 2009 and a total of 200 members thereafter. A one-time modification may allow for an additional increase in membership (or elimination of the membership cap) by administrative approval in accordance with the provisions of BMC 20.16.010I. Such an administrative modification may be granted only after assessment of the impacts of the increases allowed by this Order.

    Issues relating to the addition to the storage shed, as permitted by BLD2006-0009, shall be resolved prior to any increase in the membership.

    The applicant shall comply with the requirements of a landscaping plan submitted to and approved by the Planning Department, as required by the 1991 Conditional Use Permit, provided that landscaping along the fence abutting Willow Road shall not be required to impair the visibility into the facility through the removable panel, and the required landscaping shall be consistent with the neighborhood character. Full screening of the fence shall not be required.

    Paved parking facilities shall comply with the requirements of BMC 20.12.010. Wheel stops and landscaping, in accordance with the approved landscaping plan, shall be provided as required by the Code. Adequate parking facilities shall be maintained to ensure that parking for the users of the facility does not spillover onto neighborhood streets. A minimum of 19 spaces (the 16 required by the 1991 CUP plus three for the increased membership) shall be maintained at all times. Additional existing spaces may be required to accommodate the actual traffic generated by the facility now or in the future. A 22-foot wide paved access way shall be maintained. All required approvals and permits for improvements to the site shall be obtained prior to the commencement of work.

    Existing vegetative buffers along property lines shall be maintained during the life of the use. Any dead or diseased plants shall be replaced with specimens that provide at least the same amount of screening.

    Bicycle storage on site shall be maintained at least at the existing levels, as shown on the materials provided in support of the application (rack at entrance and rings on bathhouse).

    Conditions of the 1991 conditional use permit shall remain in effect except as modified herein. Use of the site for activities other than those currently associated with the swimming pool/club shall require a new or modified conditional use permit.

    Said Conditional Use Permit is also conditioned on compliance with the City of Bellingham Zoning Ordinance and other rules and regulations of the City.

    A complete building permit application for the proposed facility, or commencement of the use if no building permit is required, must occur within two years of the Hearing Examiner decision date as listed above or the conditional use approval will expire.

    No use or occupancy will be allowed under this Permit until there has been full compliance with the above conditions.

    APPEAL: Any party aggrieved by an action of the Hearing Examiner may file an action in the Superior Court of Whatcom County to review the Hearing Examiner’s decision. Any such action shall be governed by and filed within the time periods provided by RCW Chapter 36.70C.
