The City of Bellingham Hearing Examiner will hold a public hearing to take testimony on the following proposals:

1. VAR2013-00008 / CAP2013-00009: Replacement of a failing on-site septic system (OSS) with a new OSS that includes; new drain field, tank farm/treatment filters, gravity and force main pipes within a geologically hazardous area and its associated buffer. OSS's are not allowed within geologically hazardous areas or their associated buffers, so a variance is required. The project is located at Woodstock Farm, 1200 Chuckanut Drive (lengthy legal). It is not within shoreline jurisdiction of Bellingham Bay. Residential Single Land Use Designation. VAR2013-00010 / CAP2013-00001: Consideration of a Variance from the Critical Areas Ordinance (BMC 16.55) to develop a 11,348 square-foot lot for a single-family residence and garage with a 2,038 square-foot footprint. The entire lot is in a Category I wetland buffer. The project includes protection of adjacent trees in the wetland buffer through fencing and lot design.. The proposal is located at 1448 Iris Lane, and legally described as Lot 2 Iris lane Short Plat as Rec AF 2040203122. Residential-Single Attached, 7,200 square foot minimum lot size, Land Use Designation. Christopher and Nancy Haley, owners/applicants. South Neighborhood, Area 8.

SUB2012-00028 / VAR2013-00005: A subdivision variance from street construction requirement for a three-lot short plat known as the Berglund Short Plat #2417. Preliminary short plat approval was issued on December 31, 2012. A condition of approval requires the construction of Verona Street, currently unimproved to minimum standard. The variance application requests relief from this requirement and proposes that primary access to the short plat parcels be from the improved alley. The project is located at 1223 and 1241 Verona Street (lengthy legal). Residential Single, Detached Land Use Designation Land Use Designation. Garret O'Brien, applicant; Rick Berglund, owner. The full applications are available for viewing at the address listed below. Staff reports will be available at the Planning Department approximately one week before the hearing.

You may comment on the proposal by sending written comments to the Planning Department, City Hall, 210 Lottie Street, Bellingham, WA 98225. All written comments should be received during office hours before the hearing, or you may submit them at the hearing if you include an additional copy for the recording secretary. You may also request a copy of the Hearing Examiner’s decision and your appeal rights.
